Warning ; Do Not Torture Suspect Accused of Posting Ruto’s Fake Funeral

A Bungoma resident, Benson Malova Ashiko, was arraigned at the Milimani Law Courts on Monday, January 27, after being arrested for allegedly sharing a viral image depicting President William Ruto’s funeral alongside a condolence message to the First Family.

Charges Against Benson Ashiko

According to an affidavit filed by Corporal Edwin Metto from the Directorate of Criminal Investigations (DCI) Serious Crimes Unit, the post contained misleading information meant to harm the president’s reputation and cause distress to his family, as their images were also included.

“The comments made on the post are grossly offensive and detrimental to the victim (President Ruto) and his family, implying death had befallen the president,” stated Cpl. Metto.

Ashiko was charged under Section 23 of the Computer Misuse and Cybercrimes Act for publishing false information.

Court’s Warning Against Torture

Chief Magistrate Susan Shitubi issued a stern warning to the DCI officers, cautioning them against mistreating the suspect amid concerns for his welfare.

She directed that Ashiko be taken for medical attention after reports indicated that he is asthmatic and had not received treatment since his arrest.

“The investigating officer already has the phone and can extract the necessary evidence. The suspect is asthmatic and has yet to receive medical care. Just because this case involves a high-profile individual, do not subject him to torture. If he must be charged, do so, but ensure he is treated and kept in humane conditions,” ruled Magistrate Shitubi.

She further ordered that Ashiko remain in custody at Muthaiga Police Station for four days to allow police to conclude their investigations. He will be eligible for release on January 30 upon payment of a KSh 5,000 cash bail or an alternative bond of KSh 50,000.

The case has reignited discussions on the responsible use of social media and the potential consequences of sharing misleading or false information. Investigations are ongoing.
