Gachagua To Court To Seeks Court Protection from Impeachment
In a bold legal maneuver aimed at halting his impeachment, Deputy President Rigathi Gachagua has filed a petition at the High Court seeking to suspend the impeachment motion currently before the National Assembly. On Thursday, Gachagua, through his legal team, argued that the push to impeach him is rooted in deceit and the distortion of crucial facts, making the entire process unjust.
The Deputy President also accused National Assembly Speaker Moses Wetangula and his deputy, Gladys Shollei, of showing open bias by publicly expressing their preferred outcome regarding his impeachment. Gachagua claims that the motion is a politically driven attempt to undermine the will of the Kenyan people, portraying it as an orchestrated campaign with malicious intentions.
According to Gachagua, the impeachment process lacks constitutional merit and is being used to serve unjustifiable political purposes. He further criticized the National Assembly for providing insufficient time for public participation, which he argued is essential for fair and meaningful engagement in such a serious matter.
In his petition, Gachagua is asking the court to prevent the National Assembly from advancing, approving, or forwarding any resolutions on the impeachment motion that was introduced on September 26. This is the fourth time the Deputy President has taken legal action in an effort to halt the impeachment process, following three earlier attempts that were dismissed.
The most recent petition challenging the impeachment failed on September 30, when a three-judge bench declined to issue any interim orders to stop the process. The court directed the involved parties to appear for a mention on October 10, after dismissing prior petitions from former United Democratic Alliance Secretary General Cleophas Malalah and civil society group Sheria Mtaani.
This latest legal challenge comes just days before public participation on the motion is set to begin on October 4.
